30 Day Account - Terms & Conditions

 APPLICATION FOR CREDIT

The Applicant hereby applies to NAOL Australia Pty Ltd to purchase NAOL Australia Pty Ltd goods on credit and agrees to be bound to the following terms and conditions in relation to Application for credit and to NAOL Australia Pty Ltd's 30 Day Account Terms & Conditions of sale.

IN CONSIDERATION OF NAOL AUSTRALIA PTY LTD AGREEING TO CONSIDER A CREDIT APPLICATION FROM THE APPLICANT the parties agree that:

1. NAOL Australia Pty Ltd shall be under no obligation to grant the Application for credit or to supply any goods or services on credit to the Applicant.
2. NAOL Australia Pty Ltd may request copies of financial accounts of the Applicant for any financial period and any credit references It considers necessary in order to consider the Applicants Application for credit.
3. The Applicant warrants to NAOL Australia Pty Ltd that:
   
   3.1   the information supplied by the Applicant pursuant to this Application
          is true and correct;
   3.2   it will notify NAOL Australia Pty Ltd of any changes or developments adversely
          affecting the Applicant;
   3.3   NAOL Australia Pty Ltd may rely upon all the information provided in the extent
          that NAOL Australia Pty Ltd is induced to make a decision on the basis of
          the truth and accuracy of the information provided in this Application; 
   3.4   The applicant agrees that should this Application be accepted by NAOL Australia Pty Ltd that
          payment of all invoices shall be made 30 days from the last trading day of the month in
          which the goods where purchased, and accepts that interest shall accrue calculated at daily rests
          being the rate from time to time charged by NAOL Australia Pty Ltd customers reflecting
          a genuine pre-estimate of NAOL Australia Pty Ltd’s liquidated damages.
   
4. The Applicant agrees that if NAOL Australia Pty Ltd approves this Application then if NAOL Australia Pty Ltd so requires a director or directors of the Applicant, the Applicant will in consideration of the approval guarantee unto NAOL Australia Pty Ltd the Applicant's observance of the attached 30 Day Account Terms & Conditions.
5. All signatories to this Application, whose names appear herein, agree to be personally liable both jointly and or severally for any debts incurred by the Applicant.
6. The Applicant agrees that NAOL Australia Pty Ltd may seek any information concerning the status and financial affairs of the Applicant from any credit agency at any time.
7. NAOL Australia Pty Ltd shall not under any privacy legislation disclose any personal information given by the Applicant to NAOL Australia Pty Ltd pursuant to this Application to any entity unless provided for the purposes of this Application or with the consent of the Applicant.
8. Should NAOL Australia Pty Ltd approve this Application for Credit and should the Applicant purchase any goods from NAOL Australia Pty Ltd then the Applicant agrees that it has read and understands NAOL Australia Pty Ltd’s 30 Day Account Terms & Conditions of supplying goods which shall apply to each and every sale.
9. The provisions of this agreement bind and benefit the parties, their legal personal representatives, successors and assigns.
